Egypt’s options to use the judgment of The Hague Court in favor of Palestine

PNN – Informed Egyptian sources pointed out that Cairo has not yet made a decision to take legal decisions regarding the judgment of The Hague Tribunal against the Zionist regime, and examined the options for the future and the extent of its impact.

According to the International group of Pakistan News Network, Informed sources say that the Egyptian government has not yet decided to take a legal step at the international level in order to support the implementation of the International Court of Justice verdict regarding the case of Israel’s genocide in the Gaza Strip. A decision that guarantees the implementation of temporary and urgent measures aimed at supporting the Palestinians and preventing the crime of killing Palestinians and the immediate provision of humanitarian needs in the Gaza Strip.

In an interview with al-Arabi al-Jadeed, these sources stated that Egypt’s official estimates did not have any benefit in escalating the situation against Israel, and Cairo was satisfied with the statement of the Egyptian Ministry of Foreign Affairs on Friday and simply asked Israel to take all the measures mentioned in the decision of the International Court of Justice. The Egyptian government once again asked the Security Council and influential international parties to take responsibility for a comprehensive and permanent ceasefire in Gaza.

According to Al-Arabi Al-Jadeed, Friday’s ruling by the International Court of Justice once again led to talk about Egypt’s role in delivering humanitarian aid to Gaza and stopping the war.

Egypt’s options for implementing the decision of The Hague Tribunal

The former assistant to the Egyptian foreign minister, Ambassador Abdallah al-Ashal, told Al Arabi Al-Jadeed about this: Egypt cannot bear the consequences of going beyond the statement of the Egyptian Ministry of Foreign Affairs, which only encourages Israel to accept the decisions of The Hague Court on the import of aid to the Gaza Strip. Proof of that is the speech of President Abdel Fattah al-Sisi, who previously said that we cannot send aid to the Gaza Strip because Israel is blocking it on the other side. Therefore, I do not think that Egypt can intervene in the case that is being processed in the Court of Justice, because it has many consequences for Cairo that it cannot bear.

Regarding the actions that Egypt can take after the decision of The Hague Court, Al-Ashal said that “Cairo is expected to make several diplomatic and political moves at the international level, go to the UN Security Council, request a special meeting to reach a recommendation to implement the decisions of the International Court of Justice, not the resolution. After that, it will go to the UN General Assembly, which can impose sanctions on Israel or form an international force to escort convoys carrying humanitarian aid to Gaza.

He explained: Although the decision of the International Court of Justice against Israel has no practical effect, it has a great moral and legal effect for Israel, which was disgraced in front of the world after being convicted in court.

Another former assistant to the Egyptian Foreign Minister, Ambassador Rekha Ahmed Hassan, says: The responsibility of obliging Israel to implement the urgent decisions of the International Court of Justice rests with the United Nations Security Council, as the executive body of the international organization. Therefore, the UN Secretary-General, Antonio Guterres, will refer the Court’s decisions to the Security Council so that the Council can adopt an executive decision against Israel to implement these decisions.

He added: Two things are clear here: First; Israel’s evasion of the judgment is based on the fact that the court did not decide to stop the fighting and gave Israel a full month to submit a report on the implementation of the court’s decisions. Meanwhile, the accused has the right to evaluate himself and his level of commitment to the decisions. Second; The ability of the United States to veto what the Security Council may adopt against Israel and issue a binding resolution for Israel. Both cases are in the service of Israel, unless Washington changes its position and supports the implementation of the decisions of the International Court of Justice.

Rekha Ahmad Hassan explained that Egypt is not the executive authority of The Hague decisions, but is fully ready to actively participate in its implementation with the United Nations.

On the other hand, Professor of Political Sociology at the American University in Cairo, Saeed Sadegh said: Israel must commit to facilitating the entry of international aid from Egypt, and if Israel refuses to open the crossing, Egypt in turn can formally present evidence because Israel’s refusal is a violation of the International Court of Justice ruling that He called for facilitating the sending of aid to the people of Gaza.

At the same time, he clarified: Egypt can only request permission to send more aid to Gaza and record Israel’s position in rejecting this request. Therefore, in this way, it can prove that the party that closes the passage is Israel.

On the other hand, Palestinian lawyer and human rights activist Salah Abdul Ati said: The decision of the International Court of Justice considers Israel responsible for the arrival of aid, and Tel Aviv must take all measures in this regard, including guaranteeing the arrival of humanitarian aid and preventing the destruction of civilians and the crime of genocide.

On the other hand, Egyptian analyst Ammar Fayed says: I do not think that the judgment of The Hague Tribunal will affect Egypt’s approach regarding the Rafah crossing, because Cairo adheres to a rigid hypothesis, which is that it must treat the Gaza Strip as an occupied territory, so with the coordination of the occupying authority with the Strip Gaza behave.

He explained that, of course, the general goal of Cairo’s policy is not the unwillingness to recognize the sovereignty of Hamas in the Gaza Strip, but rather not to create a political separation between Gaza and the West Bank, because it believes that this is the main goal of the occupying side.

This Egyptian political analyst continued: Before the war, this was politically understandable, but now the insistence on delivering aid by sending it from the Rafah crossing to the Karam Shalom crossing in order to be inspected by the occupying authorities and given permission to enter Gaza has reduced the level and quality. Of course, there is another factor that makes Egypt adhere to these arrangements and be afraid of making a decision to allow trucks to enter directly through the Rafah crossing, and that is that Israel has warned that in this case it will bombard the trucks and the Rafah crossing.
