The decision is a setback for Trump, who must now pin his hopes on the U.S. Supreme Court to block the case, Reuters reported. His lawyers have filed a similar emergency motion to stay the sentencing, and the hearing is set for Friday in New York State Court in Manhattan.
Manhattan prosecutors responded in court on Thursday morning, opposing Trump’s request to stay the sentencing.
Trump, who is immune from prosecution because of his upcoming inauguration on Jan. 20, has been granted immunity from prosecution by the Supreme Court, which the Supreme Court had previously upheld.
The president-elect is still due to appear in court on Jan. 10 but may appear online instead of in person.
